These Terms & Conditions (“Terms”) govern your use of the public-facing website operated by MW.Codes (the “Site”) and the enquiry/contact form available on it (the “Contact Form”). By browsing the Site or submitting the Contact Form, you agree to these Terms.
If you do not agree, do not use the Site or submit the Contact Form.
1) Who we are
“MW.Codes”, “we”, “us”, or “our” refers to the operator of the Site located at https://mw.codes/. You can reach us at hello@mw.codes.
These Terms are designed solely for the public Site and Contact Form. They do not govern project work, paid services, or client portal usage, which are covered by their own agreements.
2) Eligibility & basic rules
- You confirm you are at least 18 years old (or using the Site with the supervision/consent of a responsible adult).<br />
- You will use the Site only for lawful purposes and in accordance with these Terms.<br />
- You will not attempt to circumvent security, interfere with the Site’s operation, or access non-public areas.
3) Information on the Site (no advice)
Content on the Site is for general information only. It is not legal, financial, or professional advice. You should obtain professional or specialist advice before taking, or refraining from, any action based on Site content. We may update, correct, or remove content at any time without notice.
4) Contact Form & enquiries
The Contact Form is provided for genuine business enquiries.
By submitting an enquiry, you:
- warrant that the information you provide is accurate and not misleading;<br />
- confirm you have authority to share any details you submit;<br />
- must not include sensitive personal data (e.g., health, financial account numbers, national insurance numbers) or illegal, abusive, or infringing material;<br />
- agree that we may use the details you provide to respond to you, to assess your enquiry, and to maintain appropriate records.
We may ignore, reject, or block submissions we reasonably consider spam, abusive, or irrelevant. The Contact Form is not monitored 24/7 and we do not guarantee any response time.
Attachments: If the form or follow-up email allows files, you are responsible for ensuring they are safe, lawful, and free of malware. Do not submit content you do not have the right to share.
5) Privacy & data (summary)
A separate Privacy Notice may apply and provides more detail. In summary:
- We process Contact Form information (e.g., name, email, message, context) only to handle your enquiry and operate the Site.<br />
- We may use reputable service providers (e.g., hosting, email, form handling) subject to appropriate safeguards.<br />
- We do not sell your data.<br />
- Do not provide special category data via the Contact Form.<br />
- You can contact hello@mw.codes for data rights queries.
If analytics, error logging, or performance tools are active, we aim to capture only technical information necessary for security and reliability (e.g., device/browser type, basic usage patterns). See the Privacy Notice for details.
6) Cookies & similar technologies
The Site may use strictly necessary cookies and, if enabled, optional cookies for analytics/performance. Where required, a banner/controls will allow you to manage preferences. See the Privacy Notice for details.
7) Intellectual property
- The Site’s design, text, graphics, logos, icons, images, and code (the “Content”) are owned by or licensed to MW.Codes.<br />
- We grant you a limited, revocable, non-transferable licence to access and view the Site for your personal or internal business use.<br />
- You must not copy, reproduce, distribute, modify, or create derivative works from the Content without our prior written consent, except as permitted by law (e.g., brief quotations with attribution).
If you believe any material on the Site infringes your rights, contact hello@mw.codes with details and evidence.
8) Acceptable Use Policy (AUP)
You must not:
- use the Site or Contact Form for unlawful, defamatory, fraudulent, deceptive, harassing, hateful, or otherwise harmful activity;<br />
- infringe third-party intellectual property, privacy, or publicity rights;<br />
- upload or transmit viruses, malware, or other harmful code;<br />
- attempt to gain unauthorised access to systems, data, or accounts;<br />
- scrape, mine, or harvest data from the Site beyond normal browser usage;<br />
- overload or disrupt the Site (e.g., via high-frequency automated requests).
We may monitor for abuse and take reasonable steps to protect the Site and our users.
9) Third-party links & components
The Site may contain links to third-party websites or deploy third-party components (e.g., CDNs, fonts, scripts). We do not control or endorse third-party content and are not responsible for their availability, security, or practices. Your use of third parties is at your own risk and subject to their terms.
10) Availability, maintenance & changes
We aim to keep the Site available and secure, but do not guarantee uninterrupted or error-free operation. We may suspend, withdraw, or restrict the Site for maintenance, updates, or legal/security reasons, with or without notice.
11) Security
We take reasonable steps to secure the Site and Contact Form but cannot guarantee absolute security. Email is not always secure end-to-end; avoid sending sensitive data. If you discover a vulnerability, please notify hello@mw.codes promptly and avoid public disclosure until we have assessed it.
12) Disclaimers
The Site and its Content are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will meet your requirements, be compatible with your systems, or be free from errors or harmful code.
13) Limitation of liability
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be limited.
Subject to the above:
- we shall not be liable for indirect, incidental, special, consequential, or punitive damages; and<br />
- our total aggregate liability arising out of or in connection with your use of the Site or Contact Form shall not exceed £100 or, if higher, the amount (if any) you have paid to us in connection with your use of the Site (most visitors pay nothing).
You remain responsible for ensuring your own systems and data are protected (e.g., backups, anti-virus, secure networks).
14) Indemnity (business users)
If you use the Site in the course of business, you agree to indemnify and hold MW.Codes harmless from claims, damages, liabilities, costs, and expenses arising from: (a) your breach of these Terms; (b) your misuse of the Site; or (c) content you submit via the Contact Form.
15) Force majeure
We are not responsible for failures or delays caused by events beyond our reasonable control, including internet or hosting outages, third-party failures, denial-of-service attacks, labour disputes, acts of God, or changes in law.
16) Changes to the Site & these Terms
We may update the Site and these Terms from time to time. The “Last updated” date in the page header indicates when changes were made. Continued use of the Site after changes constitutes acceptance of the revised Terms.
17) Severability, waiver & assignment
If any provision of these Terms is held invalid or unenforceable, the remainder remains in full force. Our failure to enforce any right is not a waiver. We may assign our rights and obligations under these Terms; you may not assign without our prior written consent.
18) Entire agreement
These Terms constitute the entire agreement between you and MW.Codes regarding the public Site and Contact Form and supersede prior statements or representations on the same subject. They do not replace any service contracts, NDAs, or statements of work that may separately apply.
19) Governing law & jurisdiction
These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
20) Contact & notices
For questions, notices, or complaints about the Site or these Terms, email hello@mw.codes. If you contact us about a rights issue, include sufficient detail for us to identify and investigate the matter.
21) Version
These Terms are versioned by the “Last updated” date shown in the page header. Keep a copy of any version important to you.
